Lost Paradise to Bad Dreams - California's Prison-Litigation Nightmare

California was more than people, who had never been there, had even dreamed. It was better than Hollywood ever portrayed it on film. In Los Angeles, in the Spring, you cold stand on the hills above the City and see the Pacific Ocean, then turn around and see snow on the San Gabriel Mountains. Crime was low because the police were not then forced to be social workers. Everything grew, all you had to do was add water,
And Ronald Reagan became Governor, beating out Moonbeam's father, incumbent Pat Brown. m/r

In 2009, three federal judges ordered the state to release 40,000 prisoners. Is it any wonder crime is on the rise?
California Gov. Jerry Brown and the federal judiciary are locked in a dramatic constitutional battle over control of the state’s prisons. In 2009, three federal judges issued what Supreme Court Justice Antonin Scalia has dubbed "perhaps the most radical injunction issued by a court in our nation’s history": an order that California release up to 40,000 prisoners within two years to correct allegedly unconstitutional prison health care.
California has since spent more than $1 billion on new prison medical facilities, brought its correctional health care far above constitutional standards, and shed more inmates than are housed in all but a few states. Yet the judges show no sign of relinquishing their hold. California’s recent sharp increase in property crime—a rise eight times greater than the national average—may be one consequence of the judicial intervention.
The prisoner-release order was the culmination of two long-running lawsuits, and, in which an advocacy group representing California inmates, the Prison Law Office, challenged prison medical treatment. The attorneys alleged that understaffing and the incompetence of prison doctors resulted in serious misdiagnoses and long, sometimes fatal, waits for care.
In 2007, after years of litigation, a special three-judge panel was convened to consider the plaintiffs’ latest argument that overcrowding was now the primary source of remaining constitutional violations. The panel agreed, and in 2009 it ordered the state to bring the prison population, then at 150,118, down to 109,805. …

Obama orders government to prepare for impact of global warming - Washington Times
By Dave Boyer 11-1-13

President Obama issued an executive order Friday directing a government-wide effort to boost preparation in states and local communities for the impact of global warming.
The action orders federal agencies to work with states to build “resilience” against major storms and other weather extremes. For example, the president’s order directs that infrastructure projects like bridges and flood control take into consideration climate conditions of the future, which might require building structures larger or stronger — and likely at a higher price tag.

“The impacts of climate change — including an increase in prolonged periods of excessively high temperatures, more heavy downpours, an increase in wildfires, more severe droughts, permafrost thawing, ocean acidification and sea-level rise — are already affecting communities, natural resources, ecosystems, economies and public health across the nation,” the presidential order said. “The federal government must build on recent progress and pursue new strategies to improve the nation’s preparedness and resilience.”
There’s no estimate of how much the additional planning will cost. Natural disasters including Superstorm Sandy cost the U.S. economy more than $100 billion in 2012, according to the administration.

Government Sadism = Third-Party Statism

Pure Fascism, government determines the "private sector".

"At 9.15 he rang for a nurse. Why did he ring for a nurse ? To guarantee a whole hour of uninterrupted privacy." from "The Hospital" by Paddy Chayefsky

Third-Party Statism :: SteynOnline
by Mark Steyn
National Review's Happy Warrior
October 29, 2013

There's a certain amount of lingo that comes with the provision of health care. In most developed countries, these words are "doctor," "nurse," "scalpel," "appendix," that sort of thing. But American health care has its own unique vocabulary: "co-pay," "HMO," "COBRA," "doughnut hole" . . . And we're always adding to it. The latest word is "exchanges." A mere twelve months ago "exchanges" were something to do with stocks or trying to get a larger size when you're given a too-tight thong for Christmas. Now, suddenly, it's the new health-care buzzword. You go to the federal website for the "exchanges," if you can get through, and they redirect you to the state websites for the "exchanges," if they're working. In Oregon, there are some 1,700 different rules that determine eligibility for the new "exchange." In Maryland, you're advised that "we may share information provided in your application with the appropriate authorities for law enforcement and audit activities." But we're used to all that by now, aren't we? The point is it's going to be complicated, time-consuming, and in breach of almost any elementary understanding of privacy. That's what makes it quintessentially American.

Most developed nations have a public health-care system and a private health-care system — of variable quality, to be sure, but all of them far simpler to navigate than America's endlessly mutating fusion of the worst of both worlds. Obamacare stitches together the rear ends of two pantomime horses and attempts to ride it to the sunlit uplands. Good luck with that. But we should remember that this disaster has been a long time incubating. The Democrats' objection to the pre-Obama "private" health system is that Americans wound up spending more than any other country for what they argued were inferior health outcomes. But the more telling number is revealed by Avik Roy elsewhere in this issue: In 2010 (in other words, before Obamacare), U.S. government expenditures on health care were higher than those in all but three other countries in the world. …  But in reality our so-called private system was a public system in all but name.

Why did we think otherwise? That gets back to the fundamental disconnect between America's national mythology and who Americans are as a people, or at least as a voting majority, in the 21st century. To reprise the Frenchman I quoted in this space a while back, "Americans love Big Government as much as Europeans. The only difference is that Americans refuse to admit it." And, because they refuse to admit it, they've wound up with a uniquely disastrous form of statism — a kind of statism on the sly, in which the zombie husks of private industry are conscripted as the front men for de facto nationalization. As part of the sky-is-falling rhetoric over the soi-disant shutdown, the media warned that, with federal employees furloughed, many American homebuyers would be delayed in moving into their new homes.

Tragic. But how did it come about that government bureaucrats are mixed up in your home closing? It's bad enough that the feds have a piece of so many mortgages, but it's far worse that, even if you walk into the realtor's office and plunk down a certified check for the entire cost of the house, you're still obligated to comply with all the federal HUD paperwork. In many key areas of life — your home, your health, your bank — Americans now enjoy considerably less freedom of maneuver than Europeans. They don't think of it like that because it's statism at one remove. But third-party statism is inevitably more cumbersome, bureaucratic, and expensive — summed up in those commercials for "Medicare supplement plans," patiently explaining why an already hideously unaffordable taxpayer-funded entitlement nevertheless apparently requires huge additional private expenditures in order to function.

Part of the Promised Land Vision - Obamacare’s Virtual Fantasy Couldn’t Handle Messy Reality

Obamacare’s Virtual Fantasy Couldn’t Handle Messy Reality - Bloomberg

The HealthCare.gov website is a disaster -- symbolic to Obamacare opponents, disheartening to supporters, and incredibly frustrating to people who just need to buy insurance. Somecomputer experts are saying the only way to save the system is to scrap the current bloated code and start over.
Looking back, it seems crazy that neither the Barack Obama administration nor the public was prepared for the startup difficulties. … And reporting by the New York Times finds that the people involved with the system knew months ago that it was in serious trouble. “We foresee a train wreck,” one said back in February.
So why didn’t the administration realize that integrating a bunch of incompatible government databases into a seamless system with an interface just about anyone could understand was a really, really hard problem? Why was even the president seemingly taken by surprise when the system didn’t work like it might in the movies?
We have become seduced by computer glamour.

15-Year Old Boy Uses AR-15 to Defend Himself, Sister Against Home Invaders

15-Year Old Boy Uses AR-15 to Defend Himself, Sister Against Home Invaders
 10 Jan 2013

A 15-year old boy used his father’s AR-15 to defend himself and his 12-year old sister against two burglars at their home just north of Houston, Texas.

Their father is a Harris County Precinct 1 deputy constable, and the boy knew what he had to do to keep himself and his sister alive. Around 2:30 PM, two men tried to break in, with one going through the front door and the other in the back.
The boy grabbed the AR-15 and shot at them. The two later showed up at a Tomball hospital. The adult was hit three times and was flown to Memorial Hermann hospital, while the juvenile was taken back to the crime scene.
“We don't try to hide things from our children in law enforcement,” Lt. Jeffrey Stauber said. “That young boy was protecting his sister. He was in fear for his life and her life.”

The BIG LIE from the BIG LIAR - The 93 Million ObamaCare Lies

The 93 Million ObamaCare Lies | FrontPage Magazine
By Matthew Vadum On November 1, 2013
The Obama administration has known for three years that when the employer mandate is enforced in 2015 up to 93 million Americans will be forced out of their employer-sponsored health insurance plans.
This means President Obama has not only been lying to Americans for at least three years, reassuring them that they would be able to keep their current healthcare plans, but that a massive chunk of the nation’s insured will be hurt by his signature healthcare reform that leftist Democrats unethically rammed through Congress in the dead of night.
The disturbing 2010 analysis of insurance market upheaval conducted by the U.S. Department of Health and Human Services was revealed yesterday by Avik Roy of Forbes magazine.
As one commentator puts it, employers still have to decide by September 2014 if they will “pay the fine for non-coverage and force their employees into the individual exchanges, or absorb more of the skyrocketing premium costs we’re seeing this month.”
Employers “may opt for an in-between solution of private exchanges, but even that will force employees out of their current plans, contra[ry] to the Obama promise that Americans can ‘keep their plans.’”

Latino groups hope immigration has impact in Va. governor’s race

 Suzanne Gamboa 10/31/13
Latino groups are intensifying get-out-the-vote efforts in the Virginia governor’s race against a national backdrop of a congressional struggle over immigration reform.
The groups said Thursday immigration reform is a critical issue on which candidates will be measured by Latino voters in the race.
As the groups work to have a strong showing of Latino turnout in Tuesday’s race, pressure has intensified on House Republicans to move immigration reform legislation in the waning days of this congressional year.
That has helped keep the issue in the forefront as the Virginia candidates head to Election Day and groups try to turn out Latino voters in the state, home to the 16th largest population of Hispanic-eligible voters.

Stuck with all their lies: The Obamacare whiners

Fraud in the inducement from Obama-the-Liar and the Democrats. No Republicans can be blamed here! m/r

Opinion: The Obamacare whiners - Rich Lowry - POLITICO.com
Henry Waxman made a plea at the end of Wednesday’s House hearing grilling of Health and Human Services Secretary Kathleen Sebelius. The California Democrat and liberal lion asked Republicans to reach across the aisle to work with Democrats to improve Obamacare.
Yes, Henry Waxman, who has made a career of ideological witch hunts and smash-mouth partisanship, wants a cease-fire over Obamacare, or so he says.
Waxman was picking up a common liberal theme: It’s not fair that Republicans continue to oppose the president’s eponymous health care law and pick at its failures, deceits and irrationalities. If only they were more reasonable, Obamacare could be tightened up around the edges with a few technocratic fixes and go on to its glorious destiny.

It’s a little late to get or expect any Republican buy-in, though. That would have required serious compromise back in 2009, when Democrats, at the high tide of their power in the Obama era, saw no reason to make any. They ignored the polls, they ignored Scott Brown’s shocking win in Massachusetts, and they ignored normal parliamentary practices to pass the single most partisan piece of major social legislation in a century.
They insisted on this particular law, at this particular time. They own it. They own every canceled policy, every rate increase, every unintended consequence and every unpopular intended consequence. It is theirs, lock, stock and two smoking barrels.
But they can’t stop whining.
