The Supreme Court’s dangerous tampering with jury secrecy


The road to hell, it’s said, is paved with good intentions, and that holds true for a US Supreme Court ruling that essentially undermines the long-cherished and essential principle of secret jury deliberations.
Even the three conservative dissenting justices agreed that the court’s 5-3 opinion was “well-intentioned” and meant “to remedy a flaw” in the jury-selection system.
But as Justice Samuel Alito wisely noted, our system of trial by jury may not be able to endure “this attempt to perfect it.”

At issue was a Colorado man convicted of groping two teens. After trial, two jurors told defense lawyers a third juror voted guilty because the defendant was Mexican.
